Karratha Indoor Golf Liability Waiver
In consideration of being allowed to use the indoor golf facilities and related services provided by Karratha Indoor Golf, I, the undersigned, hereby acknowledge and agree to the following terms and conditions:
- Assumption of Risk: I am aware that the use of indoor golf facilities involves inherent risks, including but not limited to, the risk of injury, property damage, and other hazards associated with golfing activities.
- Age Requirement and Supervision: I confirm that I am a minimum of 17 years old, and I acknowledge that an open membership at Karratha Indoor Golf is exclusively available to individuals aged 17 and above. Members aged 16 and under must have supervision from an accompanying adult when utilising the facilities. The supervising adult should hold a parent/guardian membership to facilitate access during after-hours periods.
- Release and Waiver of Liability: I hereby release and discharge Karratha Indoor Golf, its owners, employees, agents, and representatives, from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses, whether at law or in equity, arising out of or related to my use of the indoor golf facilities.
- Voluntary Participation: I acknowledge that my participation in golf activities at Karratha Indoor Golf is voluntary, and I am participating willingly and at my own risk.
- Medical Condition: I affirm that I am in good physical condition and do not have any medical conditions that would prevent me from safely participating in indoor golf activities. I agree to inform Karratha Indoor Golf staff of any changes in my health that may affect my ability to safely use the facilities.
- Responsibility for Personal Property: I understand and agree that Karratha Indoor Golf is not responsible for the loss, theft, or damage to any personal property that I bring onto the premises.
- Compliance with Rules: I agree to comply with all rules, regulations, and instructions provided by Karratha Indoor Golf staff regarding the use of the facilities.
- Photography and Publicity: I grant Karratha Indoor Golf the right to use any photographs or videos taken of me during my use of the facilities for promotional or marketing purposes. Staff members will always ask first before taking photographs or videos of the facilities members.
- Governing Law: This waiver shall be governed by and construed in accordance with the laws of Western Australia and any legal action or proceeding related to this waiver shall be brought exclusively in the courts located within City of Karratha.
I HAVE READ AND UNDERSTAND THIS WAIVER AND RELEASE OF LIABILITY, AND I VOLUNTARILY AGREE TO ITS TERMS.
